The deal, brand to brand.
What we ask of the makers listed here and what we owe them in return: who owns the photographs, how listings are reviewed, how money and returns work, and how either side can walk away.

1. This agreement
This is the agreement between Clauset and your brand. You accept it when you tick the boxes in the seller portal at onboarding, and it applies for as long as your brand is listed. It sits alongside the onboarding letter we send you, which carries the commercial terms specific to your brand — commission rate, payout schedule, and anything negotiated. Where the two differ, the letter wins on commercial terms and this agreement wins on everything else.
2. Your account
We create your seller login when we onboard you. Keep it to your team, keep the password strong, and tell us if it is compromised. Everything done under your account — listings, edits, price changes — is treated as done by you.
3. Content you upload, and who owns it
By uploading images, videos, and product descriptions, you confirm that you own or have the necessary rights to this content and authorise Clauset to use it in accordance with this agreement. You keep ownership. You grant us a non-exclusive, worldwide, royalty-free licence to host, resize, crop, standardise, display, and use that content to list, market, and promote your pieces — on the site, in our newsletter, and on our social channels. The licence lasts while your brand is listed, plus a short tail afterwards for archived editorial and material already printed or scheduled. If you upload a person’s likeness, you confirm you have their permission.
4. Listing standards
- Descriptions, materials, origin, and sizing must be accurate. Do not claim a certification you do not hold — certifications are only shown publicly once we verify the document you upload.
- No counterfeit goods, no goods you are not lawfully entitled to sell, nothing restricted under Thai law (protected wildlife, ivory, cultural antiquities, and the like).
- Prices must be genuine. A compare-at price must be a price the piece was actually offered at.
- Stock levels must be kept current. Selling a piece you cannot ship is the fastest way to lose a shelf here.
5. Review, approval, and delisting
New pieces go into a review queue and go live once approved. We may reject a piece, ask for changes, or take a live piece down — for a legal problem, a rights complaint, an inaccurate listing, or a quality standard this index is built on. We tell you why, and you can fix it and resubmit. Repeated or serious breaches end the relationship (section 12).
6. Price, commission, and tax
You set your own retail prices. You list in your own currency; the platform converts for display, and settlement is in USD. We take the commission set out in your onboarding letter on the sale value of each completed order, and we tell you in writing at least 30 days before any change to that rate. You are responsible for your own taxes — VAT registration and returns under the Revenue Code, income tax, and any withholding that applies to you.
7. Payouts
Payouts are not live yet — the platform is not taking payment. When it is: we collect the buyer's payment, deduct commission and any refunds, and pay the balance to the bank account you give us, on the schedule in your onboarding letter. We may hold back a payout while an order is disputed or a refund is being worked out.
8. Fulfilment
You make it, you pack it, you ship it, within the lead time shown on the listing. Use tracked shipping where it is available. Tell us as soon as you know an order will be late. Risk stays with you until the parcel is delivered to the buyer.
9. Returns and the buyer's rights
Selling to consumers online in Thailand is direct marketing under the Direct Sales and Direct Marketing Act B.E. 2545: the buyer may withdraw within seven days of receiving the goods. You must honour that, and you must honour the buyer’s rights when a piece arrives faulty, damaged, or not as described under the Consumer Protection Act B.E. 2522 and the Product Liability Act B.E. 2551. Made-to-order and personalised pieces may be excluded from change-of-mind returns if the listing says so before the buyer pays. The cost of a change-of-mind return is handled as set out in your onboarding letter; the cost of a faulty return is yours.
10. Buyer data
You receive buyer names and delivery addresses only to fulfil orders. Use them for nothing else — no marketing lists, no sharing, no resale — and delete them when you no longer need them. Under the Personal Data Protection Act B.E. 2562 you handle that data on our instructions and must keep it secure. Our own handling is described in the privacy policy.
11. Your promises to us, and indemnity
You warrant that you have the right to sell what you list, that your content does not infringe anyone's intellectual property or privacy, and that you comply with the laws that apply to your business. If a third party brings a claim against us because of your goods or your content, you cover our reasonable losses and costs from it. We each stay responsible for our own negligence.
12. Ending it
Either side can end this agreement with 30 days' written notice. We can suspend or end it immediately for a serious breach — counterfeits, fraud, a rights infringement you will not fix, or repeated failure to ship. On termination we delist your pieces; you keep your content, and we remove your uploads on request except where we must keep records for tax or dispute purposes. Orders already placed must still be fulfilled.
13. Liability
Neither of us is liable to the other for indirect or consequential loss, or for lost profit. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited — including a seller's liability to a consumer, which cannot be contracted away.
14. Changes and governing law
We may update this agreement; we give you notice and the date at the top changes. Continuing to list after the notice period means you accept the new version. This agreement is governed by Thai law, and the Thai courts have jurisdiction. It works alongside our Terms of Service.
